Have you read the Dummitt opinion requiring a manufacturer of a “durable” device to warn about risks of other products used in conjunction with the device? If not, you should. The plaintiff’s bar is excited about the opinion, calling it “a landmark ruling.” Either way, that opinion and similar others highlight the need for deep knowledge of the science regarding both real and faux “toxins.”
