Gardere Wynn has published an interesting new "alert" on a recent Texas trial court ruling said to have – in dicta – embraced the idea of applying the public trust doctrine to air as well as to water. The alert provides a nice update for anyone lacking the time to keep track of what’s going on in the global warming cases.
