As I’ve been saying for years, there is a cure: transparency. But lots of constituencies do not want real transparency across all of asbestos litigation. Those constituencies include some (not all) plaintiff’s lawyers, insurers, futures representatives, asbestos trustees, defendants, expert witnesses and legislators.
Getting rid of kudzu is not easy, especially in the "make a deal" world of bankruptcy courts.
