Crowell & Moring’s Litigation Forecast 2014

Crowell and Moring issued its Litigation Forecast 2014, and it’s interesting. Most striking to me, however, is that the forecast did not mention product liability claims (e.g asbestos, benzene) or bankrupcties driven by mass torts. Maybe the writers followed the adage uttered by every parent: "If you cannot say anything nice, then ……"

Asbestos litigation did, however, sneak in the back door via mention of asbestos claims serving as the backdrop for the 2013 follow the fortunes ruling by the New York Court of Appeals in a reinsurance caseknown as USF&G v. AmRe.
